I give consent for the sessions to be heard and watched to assist in the quality of the programming and the safety of all involved by the following parties of Diamond Teachers Group:

-Jenna Canning, OCT (Administrative Assistant)
I understand that the contents of all recorded sessions will be kept confidential and my child(ren)’s identities will not be disclosed unless required by law.

IN CONSIDERATION of the mutual promises and agreements contained in this Contract, Client hires Company, and Company agrees to provide tutors and tutoring services to Client, on the following terms and conditions:

GENERAL

1. Fees shall be charged at the following rates:
Elementary/High School
-Thirty-seven dollars and fifty cents ($37.50) per 30-minute session
-Fifty five dollars ($55) per 45-minute session
-Seventy dollars ($70) per 60-minute session
-One hundred five dollars ($105.00) per 90-minute session
Post Secondary
-Seventy five dollars ($75.00) per 60-minute session
-One hundred twelve dollars fifty cents ($112.50) per 90-minute session
Languages (ESL/FSL/SSL)
-Fifty dollars ($50) per 60-minute session
TOEFL and/or IELTS
-Sixty five dollars ($65) per 60-minute session

on an ongoing basis whereby Client will be charged for the first session in advance then after each session is completed thereafter. Sessions booked on a one-time basis will be charged in full at the time of booking. Fees are subject to change for additional students. Client will provide a credit card to be kept on file for all charges. Client can view payments and tutoring schedule by logging into their account through Diamond Teachers Group @ Teachworks.
2. Client agrees that an adult/parent/guardian will be home for the entirety of each tutoring session when Tutor is present with the Student online. Company and Tutor are only responsible for the education, and not the caretaking, of the Student.
3. Company shall provide Client with a minimum of thirty (30) days written notice of any change in the hourly rates.
4. The Company will not charge Client for any extra time outside the scheduled session unless the Client gives Tutor or Company approval in writing or verbally. As a result, the Client/Student understands that sessions will end at the precise end time.
5. Any study materials required for the tutoring sessions shall be purchased by Client and are not included in the regular tutoring fees. If Client would like the Company to use specific materials with the Student that require a cost, the Client agrees to pay for the materials for the Student and, if required, tutor of the Company.
6. The Client understands and accepts that the Tutor is not able to support students during timed assignments or tests.

LATE ARRIVAL

7. If the student arrives late for the tutoring session, the session will end at the regularly scheduled time and they will not receive an extended session for time lost. However, if the tutor arrives late for the tutoring session, the time lost will be made up either by extending the current session or adding time to a future session. The choice is to be discussed and agreed upon by the Company and client. In the event of issues with technology or other unforeseen issues outside of the Client and Tutor’s control, the determination of making up time and/or receiving credit will be at the discretion of the Company.

CANCELING AND RESCHEDULING

8. If Client wishes to reschedule, cancel or reduce the length of a session, Client must give Company and Tutor a minimum of twenty-four (24) hours’ notice before the scheduled session. If the Client does not give twenty-four hours’ notice, then the Company will charge them full price for the session. If sufficient notice is given to both Company and Tutor, then the session may be rescheduled or reduced without penalty.
9. If Company/Tutor must reschedule or postpone a tutoring session in the event of extreme weather conditions, unexpected illness of the tutor(s), or other safety or health emergencies, Company/Tutor will make it a priority to notify Client as soon as possible and any rescheduled sessions shall be scheduled as soon as it is conveniently possible.

TERMINATION

10. Either party may terminate this Agreement by providing the other party with fourteen (14) days’ written notice. Such notice shall be delivered by email. If the Client does not wish or cannot accommodate the final two weeks of sessions after giving notice, then they may opt to pay and/or use credits to pay for the equivalent fees for those sessions.
11. If Tutor attempts to solicit tutoring sessions privately at any time, the Client must inform the Company. The Client or Tutor shall not solicit additional tutoring hours outside those that are scheduled by the Company and for up to a year after the Tutor or Client leaves the Company.

INDEMNIFICATION

12. Client shall not hold Tutor or Company responsible for any academic results that do not satisfy Client’s expectations. Tutor and Company do not make any guarantees regarding the level of academic improvement the student will achieve. Ultimately, it is the student's responsibility to invest the time and effort needed to achieve academic goals.

No amendment to this agreement will be binding unless it is provided in writing and signed by both the Company and Client.
